The Committee on Energy and Manufacturing moves to amend the bill on page 5, section 4, beginning on line 32, by striking out subsection (f) in its entirety and inserting in lieu thereof a new subsection (f) to read as follows:

 “(f) To determine the amount of a bond required in accordance with this act, the DEP shall assess a bond value based upon the total disturbed acreage of land upon which the wind generation or solar generation facility is operated; Provided, however, That no bond shall be less than $150,000.00.”;

On page 7, section 5, beginning on line 1 after the word “the” by striking out the words “Office of the West Virginia Treasurer” and inserting in lieu thereof the words “State Treasury”;

And,

On page 7, section 5, on line 7, after the word “this” by inserting the word “program”.
